U.S. businessman and his New York-based company and two others and their company in California were indicted today in Washington, D.C., on charges of illegally exporting millions of dollars worth of computer-related equipment from the United States to Iran via the United Arab Emirates (UAE).
Jeng “Jay” Shih, 53, a U.S. citizen, and his Queens, New York company, Sunrise Technologies and Trading Company, were indicted in the District of Columbia on 27 counts relating to the illegal export of computer-related equipment to Iran without first having obtained the required license from the Department of Treasury.
The indictment charges Shih and his company with one count of conspiracy; 13 counts of violating the International Emergency Economic Powers Act (IEEPA); 13 counts of making or causing to be made false statements to the United States; and one allegation for criminal forfeiture of property and proceeds derived from these offenses.
Shih was arrested on a criminal complaint in New York on April 6, 2011, and had his initial appearance in court in New York on April 7, 2011. If convicted, he faces a maximum sentence of 20 years in prison and a $1 million fine for each of the IEEPA counts and five years for each false statement count.
In addition, Massoud Habibion, 48, aka “Matt Habibion” and “Matt Habi,” and Mohsen Motamedian, 43, aka “Max Motamedian” and “Max Ehsan,” both U.S. citizens, and their Costa Mesa, California, company, Online Micro LLC, were indicted in the District of Columbia on 32 counts relating to the illegal export of computer-related equipment to Iran without the required license from the Department of Treasury.
Habibion was charged with one count of conspiracy, 14 counts of violating IEEPA, 14 counts of making or causing false statements to the United States and four counts of obstruction of justice. Motamedian was charged with one count of conspiracy, 14 counts of violating IEEPA, 14 counts of making or causing false statements to the United States and one count of obstruction of justice.
Habibion and Motamedian were arrested on a criminal complaint in California on April 7, 2011, and had their initial appearance in court in the Central District of California on April 7, 2011. If convicted, both defendants face a maximum sentence of 20 years in prison and $1 million fine for each of the IEEPA counts, and five years for each false statement and 20 years for each obstruction of justice count.
According to the affidavit filed in support of the Shih criminal complaint, in 2006, Commerce Department agents conducted an outreach visit to Shih’s business in New York where they met Shih and informed him about U.S. laws governing the export of goods from the United States to other countries, particularly embargoed countries like Iran. In April 2010, ICE-Homeland Security Investigations (HSI) agents seized hundreds of laptop computers that originated from Sunrise and were destined for Dubai, UAE. Communications related to these shipments indicated that the purchasers were located in Iran, according to the affidavit.
The affidavit alleges that agents subsequently identified a company in Dubai that was purchasing millions of dollars of computers from U.S. companies for export to Iran, through Dubai. ICE-HSI agents arrested one of the company’s agents, who pleaded guilty in December 2010 and began cooperating with the government. In interviews with agents, this individual indicated that he and his company in Dubai had purchased millions worth of laptops from Shih in recent years for shipment to Iran, averaging $700,000 worth of computers each month. The affidavit alleges that agents also obtained documents indicating that more than 1,000 computers had been shipped by Shih’s company to Dubai and later to Iran, between April 9, 2010, and May 28, 2010, alone.
In February 2011, the cooperating individual met with Shih in New York. In recorded conversations, Shih allegedly told the individual he was aware of the U.S. embargo against Iran and U.S. export control laws. According to the affidavit, Shih also told the cooperating individual how to avoid detection when shipping goods to Iran by using fake invoices and indicated that he treated the seizure of some of his shipments as a “loss” when reporting business income and loses on his U.S. taxes.
The affidavit filed in support of the complaint against Habibion and Motamedian alleges that a company in Dubai, referenced above, purchased millions of dollars worth of laptop computers from Online Micro and that these computers were subsequently shipped to Iran. According to the affidavit, the agent for the Dubai company, who was arrested, pleaded guilty and began cooperating with the government, told federal agents that Habibion and Motamedian sold roughly $300,000 worth of computers to the Dubai company each month and that Habibion and Motamedian fully understood that the computers were destined for Iran.
In December 2010, the cooperating individual met with Habibion and Motamedian, wherein these defendants allegedly instructed the cooperating individual to make fake invoices to conceal that Iran was the destination of the shipments and to indicate that the end-users were in Dubai.
In addition, the affidavit alleges that in a Jan. 5, 2011, meeting, Habibion told the cooperating individual to lie to federal agents about conducting business in Iran, stating, “If they ask you, for instance, ‘Do you do business in Tehran?’ ‘No, I don't have any business in Tehran. I go there to visit my family, but I have no business there.’ They will ask such questions, it is part of their routine.”
ANOTHER VERSION
WASHINGTON – Three U.S. citizens and their two companies were indicted on Thursday for illegally exporting millions of dollars worth of computers to Iran via the United Arab Emirates, the Justice Department said.
It said Jeng Shih, 53, and his New York company, Sunrise Technologies and Trading Company, were charged with 27 counts over exports of the equipment without obtaining the required Treasury Department licenses.
Massoud Habibion, 48, and Mohsen Motamedian, 43, and their firm in Costa Mesa, California, Online Micro LLC, also were indicted in federal court in Washington, D.C., on 32 counts for illegal exports, conspiracy, false statements and obstructing justice.
As part of the investigation, U.S. government agents identified a company in Dubai that had purchased computers worth millions of dollars from U.S. companies for export to Iran, through Dubai, Justice Department officials said.
They said one of the Dubai company's employees, who was not identified, pleaded guilty in U.S. court and began cooperating in the investigation.
The employee said laptops worth millions of dollars had been purchased from Shih for shipment to Iran, averaging $700,000 worth of computers each month, the officials said.
Federal agents also obtained documents that more than 1,000 computers had been shipped by Shih's company to Dubai and later to Iran just in April and May last year.
In February, the employee met with Shih in New York and recorded conversations in which Shih allegedly said how he used fake invoices on shipments to Iran, the officials said.
They said the Dubai company also bought laptops worth millions of dollars from the California firm for shipment to Iran.
The employee said Habibion and Motamedian sold about $300,000 worth of computers to the Dubai company each month and knew that the computers were going to Iran.
At a January 5 meeting, Habibion allegedly told the employee to lie to federal agents about doing business in Iran, urging him to say, "I go there to visit my family, but I have no business there," according to court documents.
Alan note: There are reportedly other "players" in this activity and possibly a South America transit point.

Iranian man accused of illegal metal exports
By Nedra Pickler
February 1, 2011
WASHINGTON — U.S. authorities announced Tuesday that they have charged an Iranian businessman who they say acted as a "lifeline" to his country's missile program by smuggling metals and other vital materials from the United States in violation of a trade embargo.
The Justice Department said 36-year-old Milad Jafari is at large and believed to be in Iran. He was secretly charged with conspiracy, illegal export and smuggling last July and the 11-count indictment was unsealed Tuesday.
Federal officials said Jafari ran businesses in Istanbul and Tehran that would buy metals like steel and aluminum alloy from U.S. companies and export them through Turkey to hide their true destination, since exports to Iran are prohibited without authorization from the Treasury Department. The Treasury Department said that between 2007 and late 2008, Jafari's network facilitated more than $7 million in transactions for subordinates of Iran's Aerospace Industries Organization.
The Treasury Department described a family procurement business run by Jafari; his father Mohammad Javad Jafari; and brother, Mani Jafari; with his mother, Mahin Falsafi, handling the network's bank accounts. Jafari's Turkish associates, Muammer Kuntay Duransoy and Cagri Duransoy, helped with the transactions, Treasury said.
The Treasury Department on Tuesday designated the six individuals and five companies in the Jafari network as proliferators of weapons of mass destruction which freezes their assets in the United States in an attempt to isolate them from doing further business in this country.
"The Jafari network has established itself as a lifeline for Iran's missile program by providing essential materials and support for AIO," said Stuart Levey, Treasury's undersecretary for terrorism and financial intelligence.
The indictment alleged that in July 2006 Sanam Industrial Group, a subordinate of the AIO that has been sanctioned by the United States and United Nations for involvement in nuclear and ballistic missile activities, had requested that Jafari's company get a quote for 660 pounds of specialized steel welding wire. Less than a year later, Jafari's company paid a Nevada company $38,000 for that exact order while assuring the company that the wire would not be exported from Turkey or used for nuclear or ballistic weapons-related applications, the indictment said.
The charging documents also said that in 2007, Jafari's company ordered 4,410 pounds of high-grade, temperature-resistant stainless steel used in aerospace applications from an Ohio company, assuring the seller that it would not be shipped to Iran. The indictment said that a year earlier, Heavy Metals Industries in Iran placed an order with Jafari's company for 3,410 pounds of precipitation hardening steel.
Both shipments were detained by the Department of Commerce's Office of Export Enforcement before they left the United States.
But the indictment said Jafari and his associates were able to get several other shipments of other materials to Iran via Turkey. Those shipments included 1,366 pounds of commercial bronze bars from Texas, electronic testing equipment from Illinois and 6.6 pounds of custom-made brazing alloy from a California company. The indictment also noted that Jafari arranged to export fiber-optic equipment from Pennsylvania and aerosol generators from Minnesota.
The indictment sought forfeiture of $177,867.92 in connection with Jafari's alleged crimes
"Shutting down the illegal acquisition of material destined for use in weapons programs is among the highest priorities in the FBI," said Sean Joyce, executive assistant director of the FBI's National Security Branch that investigated the case. "We'll continue to pursue illegal acquisition efforts and protect our nation from the grave threat these WMD-related activities pose to our national security."

POTUS Backs Middle East Suppression
Well, you have to hand it to Obama, he is consistent in his extreme anti-Americanism. Throughout his presidency and all of the Islamic revolutions sweeping the Middle East and Africa, he has sided with the Islamic supremacists at every turn. His fierce islamophilia threatens free men the world over. Taking his marching orders from the vile America-hater and Jew-hater, the devout Muslim Sheik Qaradawi, Obama paves the way for an Islamic state in Libya. Not that it was good before, hardly. But there are degrees of evil. It can always be worse, but little matches the anti-human brutality of Islamic regimes in the twenty-first century.
He backed the Muslim Brotherhood in Egypt.
He's backed the Muslim Brotherhood in Gaza, Judea and Samaria.
He backed the brutal mullahcracy in Iran during the Iranian people's bloody march for freedom.
He's backed Hezb'Allah in Lebanon.
He's backed Islamic law at the UN in co-sponsoring a resolution of the restriction of free speech.
And he is backing Al Qaeda in Libya.

What Ever Happened to "Where Are the Jobs?"
Before the 2010 congressional elections, Rep. John Boehner (R-Ohio) and his fellow GOPers developed and implemented a simple campaign strategy: Say "where are the jobs?" over and over and over. Even though the nonpartisan Congressional Budget Office declared that President Barack Obama's stimulus package had created or saved about 3 million jobs and a recovery (albeit a weak one) was underway, the Republicans blamed Obama for screwing up the economy (not Wall Street or the Bush-Cheney administration). In politics, an attack doesn't have to be fair or accurate to work—and this one did.
Since then, have you heard Boehner screaming about jobs? No. He and his comrades have focused on one thing:

Why must POTUS and Keith Ellison Vilify Peter King?
More to the point, however, is the question of what Ellison and the others have to fear from King -- who after all, as the Chairman of the House Homeland Security Committee is being quite serious about carrying out his responsibilities. In fact, we might consider him derelict in his duties if he did not investigate this threat after foiled plots over Detroit and in Times Square; not to mention plots like the Ft. Hood massacre that unfortunately was not stopped. They claim that the hearings themselves create divisions among Americans; but judging from the reaction of most Americans to the proposed Ground Zero mosque, it appears that ship has already sailed. Besides, they never chide the administration's purveyors of "identity politics" for doing that very thing.
Are they afraid that King's inquiry might turn up something ominous? What if they found most American Muslims good people, but determined that their leaders have failed to uproot radical "charities" or mosques within their midst? Perhaps the Obama White House fears that hearings might find that it is more concerned about political correctness than it is about protecting the homeland. From their incessant opposition to such things, they seem to believe that admitting any modicum of terrorism in the name of Islam damns the entire community -- which I do not think has ever been King's position. There was a German Fifth Column operating in the United States during World War II, but it did not mean that the German-American community was disloyal. Somehow the PC brigade has a tough time with that intellectual operation.

POTUS Feels GOP & Israel Ruin His Egypt Plan

Rubin, who writes many blog posts and articles, believes that this is the most important post he has written in a long time. According to Barry, the Obama administration is pursuing a disastrous policy by trying to distinguish between the ‘bad Islamists’ from al-Qaeda and the ‘good Islamists’ from the Muslim Brotherhood.
Now we come to the paragraph I warned about, the explanation for how the administration may be about to plunge into the biggest disaster in U.S. foreign policy of…well, of a very long time.
Here it is:
“The administration is already taking steps to distinguish between various movements in the region that promote Islamic law in government. An internal assessment, ordered by the White House last month, identified large ideological differences between such movements as the Muslim Brotherhood in Egypt and al-Qaeda that will guide the U.S. approach to the region.”
Get it? Al-Qaeda is bad because it wants to attack U.S. embassies, the World Trade Center, and the Pentagon.
BUT the Muslim Brotherhood is good! Because it merely wants to seize state power, transform Egypt into an Islamist state, rule almost 90 million people with an iron hand, back Hamas in trying to destroy Israel, overthrow the Palestinian Authority, help Jordan’s Muslim Brotherhood overthrow the monarchy, and sponsor terrorism against Americans in the Middle East.
I’m sure you can see the difference. This is the nonsense that the administration has been working toward for two years. It is the doctrine pushed by the president’s advisor on terrorism, elements in the CIA, and White House ideologues. The State and Defense departments are probably horrified.
Not everyone agrees with Obama. Jennifer Rubin (no relation) urges the Obama administration to condition good relations with Egypt on keeping the Muslim Brotherhood out of the government.
The degree to which the U.S. can influence events is unclear, but we might at least start by articulating that good relations with the U.S. are dependent upon movement toward a democratic government, respect for human rights, and maintenance of the peace treaty with Israel. All of that, we should make clear, is put into question by the sort of Islamic regime that the Muslim Brotherhood would dearly love to establish.
That’s also the view of Representative Steve Chabot (R-Ohio), the new Chairman of the House Subcommittee on the Middle East and South Asia.
The US should condition aid to Egypt – now at around $1.5 billion a year – on whether the Muslim Brotherhood ends up in the government, Chabot said.
“They’re about Shari’a law, they’re about suppressing women’s rights, and I don’t think that we ought to condone that, I don’t think that ought to be any part of the future of Egypt,” he said. “We might not have the power to implement the US program, but I think with our support – financial and otherwise – that we can maybe encourage things that would ultimately be in their best long-term interests, and Israel’s and the United States’.”
That’s obviously not the view of the Obama administration, which is urging Israel not to ‘fear changes’ in the Middle East.
US President Barack Obama told Jewish donors in Miami on Friday that Israel and the United States should not be afraid of changes taking place in the Middle East.
Obama said that the world needs to be “sober” about the current transformation in the region but stressed that the West shouldn’t fear the future.
Speaking at a fund-raising dinner in Miami on Friday night, Obama said he told a group of Jewish leaders at the White House Tuesday: “We can’t be naïve about the changes that are taking place in the Middle East,” but “we should not be afraid of the possibilities of the future.”
…
Obama acknowledged Friday that when it comes to changes in the region, “there are going to be some bumps along the road,” and charting a path forward will mean US participation and a will “to seize that moment.”
“We’re going to have to be engaged and we’re going to have to be involved and we’re going to have to reach out,” he said. “But I’m actually confident that 10 years from now we’re going to be able to look back potentially and say this was the dawning of an entirely new and better era.”
Curiously, John Hinderaker apparently saw an earlier version of the article quoted above, in which Obama goes further and says
All the forces that we see building in Egypt are the forces that should be naturally aligned with the US, [and] should be aligned with Israel.
John says that claim is “far from self-evident.”
Was Obama talking about the Egyptian protesters who shouted “Jew, Jew” as they stripped Lara Logan naked and beat her with poles? Regardless of whether the “building forces” in Egypt “should be” aligned with the U.S. and Israel, I am not confident that they are. Not “all” of them, anyway.
John goes on to cite former CIA analyst Paul Pillar, who reflects the Obama administration’s optimism:
“Not everyone will find it reassuring that the gamut of prospective regimes runs all the way from the Muslim Brotherhood to al Qaeda, a Brotherhood spin-off. But our old friend Paul Pillar, now retired from the CIA, reinforces the Obama administration’s optimism:”
Paul Pillar, a longtime CIA analyst who now teaches at Georgetown University, said, “Most of the people in the intelligence community would see things on this topic very similarly to the president — that is, political Islam as a very diverse series of ideologies, all of which use a similar vocabulary, but all quite different.”
…
“The main challenge President Obama will face is a political challenge from across the aisle, and one reinforced by Israel,” said Pillar, whose portfolio included the Middle East.
One is left speechless. Turmoil in the Middle East promises a set of new regimes; the optimistic scenario, apparently, is that they will be dominated by the Muslim Brotherhood rather than al Qaeda. And the main problem this will pose for the President will come from the Republicans! And, of course–but why?–those pesky Israelis. We can describe this charitably as a remarkably Washington-centric view.
It’s also an Israel-centric view. The problem with potentially Islamist governments – according to the CIA and the Obama administration — is Israel and the Jews. Why didn’t I think of that?

The Post American Caliphate

Obama mulls Islam's post-revolt role in Mideast CBS
Revolts in N. Africa, Mideast could bring regimes rooted more in Muslim tradition than democracy (Washington Post)
The Obama administration is preparing for the prospect that Islamist governments will take hold in North Africa and the Middle East, acknowledging that the popular revolutions there will bring a more religious cast to the region's politics.
The administration is already taking steps to distinguish between various movements in the region that promote Islamic law in government. An internal assessment, ordered by the White House last month, identified large ideological differences between such movements as the Muslim Brotherhood in Egypt and al-Qaeda that will guide the U.S. approach to the region.
The Obama administration is not only preparing but is working to make this happen. What kind of statecraft is at play here? Name one Muslim country living under the sharia that is humane or free. The United States is sanctioning a global caliphate. Gd forgive us.
U.S. troops are gunned down by a shooter who screams “Allahu akbar!” before opening fire. Official statements are rushed out by Obama's State department -- the jihadi was a "lone wolf " -- not so. He was a member of any number of jihadi groups. "His motive was unclear" -- he was screaming the Islamic war chant right before he fired. "There are no links to terrorism" -- it was jihad. That is terror.
And yet the Obama Administration refuses to call the jihad attack in Germany an act of terrorism, and instead compares it to Giffords shooting.
Washington Times here:
Sound familiar? It should, because when Islam is the cause of American tragedy, President Obama hides his head in the sand.
On Wednesday, a young Kosovar named Arif Uka opened fire on a bus load of U.S. Air Force personnel in Frankfurt, Germany, killing two and wounding two more. Witnesses say he repeatedly shouted the jihadist battle cry, “Allahu akbar” as he emptied his weapon and screamed “Jihad! Jihad!” when tackled by German police. Uka’s victims had been heading to the fight in Afghanistan but because the jihadists have a global battlespace, the war came to them instead.
Mr. Obama made a typical noncommittal statement shortly after the shooting, saying it was a “stark reminder of the extraordinary sacrifices that our men and women in uniform are making all around the world to keep us safe, and the dangers that they face all around the globe.” He made no mention of the nature of the threat or the reason for the sacrifices. In this respect, he was behaving true to form.
The Frankfurt shooting is the latest in a troubling series of jihadist terror attacks in which the Obama administration refuses to face reality. Among the first was the June 1, 2009, shooting at a recruiting station in Little Rock. Abdul Hakim Mujahid Muhammad, a Muslim convert who had recently travelled to Yemen, killed one U.S. Army recruiter and wounded another. Muhammad told police if other troops had been available, he would have shot them too. The White House waited two days before making a statement that omitted any reference to the attacker or his jihadist motives.
The Nov. 5, 2009, Fort Hood massacre, in which 14 were killed and 30 wounded, was given a persistent coat of whitewash from the Obama administration. The first coat was applied with initial statements that shooter Nidal Malik Hassan was a “lone wolf” and continued through the comprehensive “force protection review” that somehow omitted any reference to Hasan’s jihadist motives or contacts with al Qaeda.
The Obama team had a similarly slippery reaction to the Dec. 25, 2009, attempted “underwear bomb” attack on Northwest flight 253. Al Qaeda-linked bomber Umar Farouk Abdulmutallab was initially not even charged with attempting to commit an act of terrorism. Faisal Shahzad, who attempted the Times Square bombing in May 2010, was also called a lone wolf with no ties to terrorism and was even described as more a victim of the economic downturn than a committed Islamic extremist. In all these cases, the initial assessments turned out to be wrong, yet the White House still obstinately refuses to discuss the jihadist motives of the terrorists involved.

Egyptians Begin to Blame US & Israel for Woes

Egyptian protesters have begun to blame the US and Israel for propping up the Mubarak government.
Egyptians understand that the world is waiting to see if President Hosni Mubarak falls to popular pressure before major leaders decide which side to support. But this is infuriating the demonstrators, who realize that six days of unrest have not accomplished their goal and that they need united international pressure in order to topple the almost-30-year incumbent.
The protests have lacked a clear leader to unite them and provide an alternative to Mubarak, and demonstrators are beginning to focus their wrath not just on Mubarak and the country’s widespread corruption, but also on the United States and, to a lesser extent, Israel. They blame Israel and the US for supporting a government because it is convenient for them, not because it is good for the Egyptian people.
“The USA does not support democracy; they’re supporting Israel, which is like their baby,” said Ahmed, a 26-year-old Cairo resident. “They think Egypt is functional because it’s in favor of their considerations.”
“I don’t care if we have peace [with Israel] or not,” Ahmed continued, echoing the indifference of many demonstrators who don’t have a clear agenda for what they want a future Egypt to look like, as long as it does not include Mubarak. “But will Israel allow us to have a real president? For example, Turkey elected an Islamic government, but it was their choice. Will Israel give us the freedom to make the same choice?” he asked.
Demonstrators are relying on the foreign press to get their message to Obama.
“Isn’t this democracy?” they asked me over and over when I said I was a journalist from America, incredulous that the country held as the pinnacle of world democracy could ignore such widespread popular sentiment.
“Obama has to be on our side. Where is your democracy?” asked Osam L, who works at a foreign bank in Cairo.
“You say Arabs are just donkeys, but the USA is supporting the system, not the people.”
The Jewish community in Cairo and Alexandria both declined to speak with the media, but told The Jerusalem Post that all of its members were safe and going about their daily routine as normally as possible.
I think that's what's called realpolitik, and no, it doesn't always lead to the most moral outcome. But if they're going to make war with us, I won't support them either.

My view is increasingly the regime will ride out the storm. The protesters have to eat sometime and work for a living. What the Egyptians lack is a charismatic figure like the Ayatollah Khomeini to rally around. ElBaradei just doesn't excite them. Mubarak will be gracefully eased out after the protests end and my guess would be that Suleiman or some acceptable figure not tainted by a close association with Mubarak will become the country's next President.

Disgusting. Alexandria has been a hotbed of anti-semitism from before Christ! That says something.
It is about secularism versus Islamism. Do you think many of those young brave souls who protested the Shah in 1979 wanted something far different than the Imams? The secular movement in Egypt is limited to a few thousand westernized elite. The masses want the Muslim Brotherhood... and they will get it.
I hope Israel is planning a plan b. Plan b is what will Israel do when Egypt abrogates the Camp David Accords. If they cut off the gas and introduce the military into the Sinai and/or aid Hamas, Israel should retake the Sinai or portions of it. That's plan b.
And another point about Obama fiddling when Mubarak burns... who's next-Jordan or Syria?
